FINANCIAL
SERVICES LITIGATION
Adams | Nye | Becht LLP counsels and represents financial services
institutions and other lenders in a wide variety of litigation
matters, including: commercial and consumer loans; transactions
secured by real and personal property collateral; construction
loan matters; operational issues encountered by financial
institutions; lender liability; fraudulent transfers; and
forged, raised, and improperly endorsed checks. We also represent
secured and unsecured creditors in workouts of troubled loans,
and in commercial and consumer bankruptcy matters in Chapter
7, 11 and 13 cases.
 |
In one case, we
successfully obtained a summary judgment for a secured
lender against homeowners who claimed that the lender
owed attorney's fees the homeowners had expended in an
insurance coverage case for landslide damage. |
 |
Another case we
tried involved a lender's right to a deficiency judgment
after foreclosure of a lien on a houseboat. We won the
case, the judgment was affirmed, and we made new law involving
foreclosures on houseboats. |
Adams | Nye | Becht LLP has successfully tried cases for, or obtained
summary judgment on behalf of, banks accused of improperly
handling funds belonging to probate estates, lenders seeking
to recover defaulted loans and foreclose security interests,
as well as in many other areas related to financial services.
